2.1 The offer and sale of Products on the Site constitute a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree No. 206 of September 6, 2005 ("Consumer Code") and by Legislative Decree No. 70 of April 9, 2003, containing the regulation of electronic commerce.
2.2 These General Terms and Conditions of Sale apply to all contracts concluded with SPV on the Site.
2.3 The General Terms and Conditions of Sale may be modified at any time. Any modifications and/or new conditions will be effective from the moment of their publication on the Site in the "General Terms and Conditions of Sale" section. Users are therefore invited to regularly access the Site and consult, before making any purchase, the most updated version of the General Terms and Conditions of Sale.
2.4 The applicable General Terms and Conditions of Sale are those in force on the date of sending the purchase order and are available in Italian.
2.5 These General Terms and Conditions of Sale do not govern the sale of products by parties other than SPV that are present on the Site through links, banners or other hyperlinks. Before carrying out commercial transactions with such parties, it is necessary to verify their sales conditions.
2.6 The user is required to carefully read these General Terms and Conditions of Sale, which SPV makes available in the "General Terms and Conditions of Sale" section of the Site and which may be stored and reproduced, as well as all other information that SPV provides on the Site, both before and during the purchase procedure.
3.1 The purchase of Products on the Site takes place after registration, pursuant to clause 4 below, and is permitted both to users who are consumers and to users who are not consumers. Physical persons are permitted to purchase only on condition that they are at least eighteen years old.
3.2 Pursuant to Article 3, Paragraph I, letter a) of the Consumer Code, it is recalled that consumers are natural persons who, in relation to the purchase of Products, act for purposes unrelated to any entrepreneurial, commercial, professional or artisan activity carried out.
3.3 SPV reserves the right to refuse or cancel orders that come from (i) a user with whom it has ongoing litigation; (ii) a user who has previously violated these GTC and/or the conditions and/or terms of the purchase contract with Spezierie Palazzo Vecchio Dott. Di Massimo SRL; (iii) a user who has been involved in fraud of any kind and, in particular, in credit card payment fraud; (iv) users who have provided false, incomplete or otherwise inaccurate identification data or who have not promptly sent SPV the documents requested by it or who have sent invalid documents.
4.1 Registration on the Site is free. To register on the Site, the user must fill out the appropriate form, entering name, surname, address, place and date of birth, telephone number, an email address and a password and click on the [Send] button. Registration on the Site, through the opening of a personal account, allows the registered user ("Registered User") to:
4.2 Registration credentials (email address and password) must be kept with extreme care and attention. They can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them. They also undertake to immediately inform Spezierie Palazzo Vecchio Dott. 4.3 The Registered User guarantees that the personal information provided during the Site registration procedure is complete and truthful and undertakes to hold SPV harmless and indemnified from any damage, compensation obligation and/or penalty arising from and/or in any way connected to the user's violation of the rules on Site registration or on the storage of registration credentials.

6.1 All products marketed by SPV on its e-commerce site spezieriepalazzovecchio.it are covered by legal warranty of conformity pursuant to and for the purposes of Articles 128 et seq. of Legislative Decree No. 206 of 2005 Consumer Code.

Purchases made on spezieriepalazzovecchio.it are safe and guaranteed and payment can be made by choosing one of the following methods:
In case of payment by advance bank transfer the order will be processed only after confirmation of receipt of the full amount. Payment must be made within 3 days from the date of the order. For correct and fast order management the Customer must indicate in the payment reference: order number, date, customer name and surname. After this deadline the order will be automatically cancelled unless there has been correspondence with [email protected] regarding the order in question.

Where the User chooses to pay by credit card the banking institution will authorize the charge of the amount related to the purchase made. In case of cancellation SPV will request the cancellation of the transaction and the reversal of the committed amount. The release times depend exclusively on the banking system. Once the transaction cancellation has been made SPV cannot in any case be held responsible for delays and/or damages caused by the banking system. SPV reserves the right to request additional information from the User or send copies of documents proving ownership of the card used. In case of refusal SPV srl reserves the right not to accept the conclusion of the contract. At no time during the purchase procedure by credit card is SPV able to know personal information related to the cardholder since the information is transmitted directly to the site of the banking institution that manages the transaction, a protected site.
ATTENTION, The 3Dsecure anti-fraud system for secure payments of Visa and Mastercard circuits is active. Most banks, when issuing these credit cards, deliver a device password. At the time of payment, you will be redirected to the https site of the IntesaSanPaolo Group where you will have to enter the credit card number and the device password. No card data is recorded on our site. This system is adopted by most secure e-commerce sites to avoid fraudulent use of credit card numbers and therefore possible disputes.
In case of denied transaction, check with your bank that you are enabled for this free service or that the password has not expired. Without entering the device password no bank transaction takes place.
By selecting the PayPal payment type, the User will be redirected to a page of the PayPal site and payment will take place according to the methods indicated there. The information provided on the PayPal site will not be shared with SPV but will be managed directly by PayPal. In case of cancellation of the order or non-acceptance by SPV the amount will be refunded to the PayPal account. SPV will in no way be responsible for delays and/or damages caused in this phase.
The shipping cost is borne by the User and will be calculated automatically by the system based on the place and shipping method. It is possible to simulate the cost from the checkout page.
Delivery times for goods vary depending on the availability in stock of the purchased product (e.g. if the product is available from the manufacturer) and the delivery methods provided for it. In any case, the delivery date is merely indicative and is in no way binding for SPV. The delivery service is suspended from December 24 to January 2. Orders received during this period will be processed at the end of the suspension period. SPV uses contracted couriers/carriers that offer the best quality/price ratio for the destination concerned: this allows us to offer Customers advantageous prices and quality service. In no case will it be possible to make deliveries by appointment and/or at predetermined times and/or days, nor will it be possible to request that the package be left unattended (for example in the garden or hallway). In case of inability to personally collect the package, it will be necessary to indicate an alternative name, or choose delivery to a Fermopoint. These instructions can be given autonomously directly to the courier, via link sent by email or SMS. In case of non-delivery of the goods due to incorrect address provided by the User or due to completed storage in the courier/carrier warehouses and/or in any case for any cause attributable to the User's behavior, a new shipment will be possible ONLY after advance payment of the same according to the methods indicated by SPV.
At the time of delivery of the goods the User is required to check: that the number of packages delivered corresponds to what is indicated in the transport document; that the packaging is intact and not altered even in the closing tapes. In case of tampering and/or breakage the User must immediately contest the shipment and/or delivery using the document received from the courier or other operator and affixing the words "RESERVE FOR GOODS CONTROL FOR ....."(indicate the reason). The User must subsequently report any damage within 3 days of receiving the goods according to the methods provided by the operator who carried out the shipment.
The right of withdrawal is regulated by the current legislation art. 64 Consumer Code as amended by LEGISLATIVE DECREE of February 21, 2014, n. 21. The User who qualifies as a Consumer as per point 3.2 has the right to withdraw from the contract for any reason and without any penalty within 14 working days and without having to bear costs other than those provided for in article 56, paragraph 2, and article 57 of the aforementioned decree. The right of withdrawal must be exercised in the following manner:
The goods must be returned to SPV within the terms of point 14 together with the authorization form received. Without prejudice to any restoration costs for ascertained damage to the original packaging, SPV will reimburse the User the full amount within 14 days of the return of the goods through the reversal procedure of the amount charged to the Credit Card or by Bank Transfer. In the latter case it will be the User's responsibility to promptly provide the bank details on which to receive the refund (Customer IBAN Code). In both cases the bank fees or the credit platform fees which are always less than 5% will be withheld from the refund.
The User forfeits the right of withdrawal and the consequent right to refund in the event that SPV ascertains the existence of even just one of the following conditions:

16.1 The purchase contract concluded on the Site is governed by Italian law.
16.2 The application to consumer Users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided by the law of the country in which they have their habitual residence is reserved, in particular in relation to the deadline for exercising the right of withdrawal, the deadline for returning the Products, in case of exercise of this right, the methods and formalities of communication thereof and the legal guarantee of conformity.
16.3 It is recalled that in the case of a consumer user, for any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, the court of the place where the user resides or has elected domicile is competent. In the case of a non-consumer user, for any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, the court of Florence has exclusive jurisdiction
16.4 The user who resides in a member state of the European Union other than Italy may also access, for any dispute relating to the application, execution and interpretation of these General Terms and Conditions of Sale, the European procedure established for small claims disputes, by Council Regulation (EC) No. 861/2007 of July 11, 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00.
